Photographer Contributor Terms & Conditions
These terms apply when you provide photographs to Outlier Gifts (“we”, “our”, “us”) for the purpose of creating and selling Outlier Gifts artwork and products.
Our artwork is created using a combination of photography, digital editing, design work and AI-assisted creative tools. AI may be used as one part of the creative process alongside manual editing and image manipulation.
By submitting your work, you agree to the following:
1. Licence to Use Images
You grant Outlier Gifts a non-exclusive, worldwide licence to use the photographs you supply for the purpose of creating original Outlier Gifts artwork, producing products based on that artwork, and marketing those products.
This may include adapting or transforming photographs using digital editing, graphic design, image manipulation and AI-assisted tools.
You retain full copyright ownership of your original photographs.
2. Materials Provided
You may be asked to provide a main photograph for adaptation, along with optional reference photographs showing details such as signage, architecture, textures, colours or alternative perspectives.
Providing additional reference images is optional, but they can help us create a more accurate and distinctive finished design.
3. Acceptance of Submissions
Outlier Gifts is not obliged to accept, develop or use every photograph submitted.
We will decide which photographs and locations are suitable for the Outlier Gifts range.
If we decide not to use your photograph, no licence fee or payment will be due.
4. Sales and Royalties
For every qualifying product sold that is based on your submitted photograph(s), you will receive a royalty of 10% of the actual selling price received by Outlier Gifts for that product.
This applies whether the product is sold:
directly to a customer by Outlier Gifts; or
at a wholesale/trade price to one of our retail stockists.
For example:
If an Outlier Gifts poster is sold directly for £25, the royalty would be £2.50.
If the same poster is sold to a retailer at a wholesale price of £12.50, the royalty would be £1.25.
The royalty is therefore based on the price actually charged by Outlier Gifts for that sale, rather than the product's recommended retail price.
Royalties are calculated on completed sales only. Cancelled or fully refunded transactions do not generate a royalty.
Payments are made monthly by bank transfer or another agreed payment method.
5. Credits
Where appropriate, you will be credited as the contributing photographer on the Outlier Gifts website and/or associated marketing materials unless you request otherwise.
6. No Guarantee of Sales
Providing a photograph does not guarantee that an artwork or product will be created from it.
We may also create artwork and subsequently decide not to release it, or discontinue an existing design at any time.
No royalty is payable unless a qualifying product based on your photograph is actually sold.
7. Exclusivity
The licence you grant Outlier Gifts is non-exclusive.
You remain free to use, publish, sell or licence your original photographs elsewhere.
8. Creating the Artwork
Outlier Gifts may adapt, edit and transform submitted photographs as part of creating the final artwork.
Our creative process can include photography, manual digital editing, colour and lighting adjustments, compositing, graphic design, cropping, reconstruction, reference imagery and all artwork is initially generated using our own custom trained AI model.
AI is therefore used as a creative tool within the design process, rather than being the sole method by which the finished artwork is produced.
The amount and type of editing required varies between designs, and some artworks may involve substantial manual adjustment and refinement before being approved for sale. Some may also require little manipulation and could be mainly AI generated, depending on each design.
9. Withdrawal and Termination
You can withdraw permission for Outlier Gifts to use your photographs by providing written notice.
Any artwork already created and offered for sale may continue to be produced and sold for up to 12 months after notice is received, with the agreed royalties continuing to be paid during that period.
10. Your Rights and Responsibilities
By submitting photographs, you confirm that:
you are the copyright holder or otherwise have the necessary rights to provide them to Outlier Gifts;
you have the authority to grant the licence described above; and
use of the photographs by Outlier Gifts under these terms will not knowingly infringe somebody else's rights.
Outlier Gifts cannot accept responsibility for third-party claims resulting from photographs being submitted by somebody who does not have the appropriate rights to them.
✦ Plain English Summary
Your photographs remain yours.
You give Outlier Gifts permission to use them as the starting point for creating our artwork.
We use a combination of photography, digital editing, design work and AI-assisted tools to create the finished pieces.
When a product based on your photograph sells, you receive 10% of the price Outlier Gifts actually sells it for.
So if we sell directly to a customer, your 10% is based on that direct selling price. If we sell it wholesale to a shop, your 10% is based on the wholesale price we receive.
You are still free to use or sell your original photographs elsewhere, and you retain copyright in them.
